  1. WHAT IS PERSONAL INFORMATION? 
    Personal Information means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information falls within certain categories, for example:

    Identifiers (e.g., name, email, telephone number, address, username); 
    Sensitive Personal Information (e.g., government identification number; precise geolocation; racial or ethnic origin; religious beliefs; health information; contents of messages when we are not the recipient; in some cases, information about a known child);
    Legally protected information (e.g., race, citizenship, marital status, sex);
    Employment-related information (e.g., current or past employment);
    Non-public educational information, including information protected under the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g, 34 C.F.R. Part 99);
    Biometrics (e.g., DNA, face/voice prints, health data) and audio, electronic, visual, thermal, or olfactory information;
    Inferences drawn from Personal Information to create a profile about preferences, characteristics, trends, predispositions, behavior, attitudes, intelligence, and aptitudes;
    Commercial information (e.g., products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies); and
    Internet or other similar activity (e.g., browsing history; content interactions). 

    Information that is not protected as Personal Information includes information that is publicly available; aggregated information (meaning data summaries or reports with Personal Information removed); and anonymized information that cannot be linked back to an individual.   

  2. STUDENT PRIVACY.
    In Short:
    The Services do not collect Personal Information from children. School districts use the Services in compliance with children and education privacy laws.  

    To protect the privacy of students online, the Company does not collect Personal Information from any minor student; therefore, the Company is not required to obtain parental consent under the Children’s Online Privacy Protection Act. Rather, each school district that uses our Services inputs students data or enables parents to input and adjust student data on the Services. As such, the school district, not the Company, is responsible for obtaining any necessary parent or guardian consent as required by applicable privacy laws.

    If you use our Services because we have a contract with your school district, we do so as a contractor and a “school official” under the Family Educational Rights and Privacy Act (“FERPA”). Each school district using the Services, and not the Company, is responsible for using the Services in compliance with FERPA, as well as any other applicable laws and regulations governing educational institutions.

  3. WHAT INFORMATION DO WE COLLECT?

    In Short: We collect the Personal Information that you provide to us voluntarily with your consent. We also automatically collect technical data, which includes some Personal Information, about your use of the Services.

    We collect Personal Information from you when you use or inquire about our Services. We only collect, use, retain, and disclose Personal Information as is adequate and relevant to the specific, express purposes described below or as reasonably necessary and proportionate to provide our Services or for other purposes that we disclose to you and are compatible with the context of how we collected your Personal Information. We collect Personal Information (1) with your consent as informed by this Privacy Notice and freely given at the time you provide the information; (2) if we have a legitimate interest in doing so; or (3) as authorized or required by law. Over the last 12 months, we have collected the following categories of Personal Information:

    From you, with your consent. We collect identifiers like your name, email address and username that you voluntarily provide to us when you:

    • Express an interest in obtaining information about us or our products and Services;

    • Participate in activities on the Services;

    • Contact us or receive help through our customer support channels; and

    • Participate in customer surveys or contests.

    We use your Personal Information collected in this manner to facilitate the delivery of our Services and to respond to your inquiries.

    From you or your school district, with consent and a legitimate interest. A central component of our Services is management of educational records. As such, we collect sensitive Personal Information in the form of student data contained in educational records either directly from the student or their guardian with consent or from the school district in our role as a service provider. 

    Automatically from your use of the Services, with a legitimate interest. We use cookies and related technologies to automatically collect certain technical data when you visit, use, or navigate the Services. Some of this technical data may qualify as Personal Information under the law. For example, we collect device and usage information like your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes. 

    You can directly control how cookies interact with your device. You can change your device settings to alert you when cookies are sent to your device, or to refuse some or all cookies from being set on your device. Alternatively, you can install a third-party plugin to control cookie behavior. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Services may then be inaccessible or not function properly. If you get a new device, install a new browser, or erase or alter your device’s cookie file or privacy settings, your privacy preferences may not be saved.

  4. HOW DO WE PROCESS YOUR INFORMATION?

    In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

    We process your Personal Information for a variety of reasons, depending on how you interact with our Services, including:

    • To provide you with our Services;

    • Fulfill any purpose to which you consent; 

    • To identify usage trends;

    • Monitor your compliance with our agreements and policies;

    • Help maintain the safety, security, and integrity of our technology assets;

    • Conduct internal testing, research, analysis, and product development, including to develop and improve our content and offerings;

    • Personalize your experience or deliver targeted ads according to your consent and stated preferences;

    • Respond to law enforcement requests and as required by applicable law, court order, or governmental regulations;

    • Identify, contact or bring legal action against persons or entities who may be causing injury to you, to us, or to others as we determine necessary; and

    • Evaluate or conduct a business transition involving some or all of our company assets where Personal Information held by us is among the assets transferred.

    We will not collect additional categories of Personal Information or use already collected Personal Information for purposes that are materially different, unrelated or not reasonably necessary or compatible with the original purpose without notice and consent to you as required by law.

  5. WHEN AND WITH WHOM DO WE DISCLOSE YOUR PERSONAL INFORMATION?

    In Short: We may share information in specific situations described in this section and/or with the following third parties.

    We will only disclose Personal Information to the third parties as described in this section, with your permission, or as required by law. In the preceding 12 months, we have disclosed Personal Information for a business purpose to the following third parties: 

    Our service providers. Our service providers like data and email hosting companies, IT vendors, and payment processors may have access to Personal Information as needed to perform their contractual obligations to us. We prohibit our service providers from selling or disclosing the Personal Information and we require all service providers to maintain confidentiality standards and appropriate technical and organizational measures to ensure the security of your Personal Information. 

    Law enforcement, and other governmental agencies, as permitted or required by law or as necessary to take action regarding illegal activities or prevent fraud or harm to any person.

    Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

    No Sale of Personal Information. We do not exchange Personal Information with third parties for monetary or other valuable consideration. If this changes in the future, we will update this Privacy Notice and provide you with a method to opt-out.

    Aggregated and Deidentified Information. We reserve the right to share aggregated, anonymized, or deidentified information about any individuals with nonaffiliated entities for marketing, advertising, research or other purposes, without restriction.

  6. HOW LONG DO WE KEEP YOUR INFORMATION?

    In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

    We will only keep your Personal Information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your Personal Information for longer than 2 years.

    When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize such information, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

  7. HOW DO WE KEEP YOUR INFORMATION SAFE?

    In Short: We aim to protect your Personal Information through a system of organizational and technical security measures.

    We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any Personal Information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your Personal Information, transmission of Personal Information to and from our Services is at your own risk. You should only access the Services within a secure environment.

  8. SERVICES OFFERED IN THE UNITED STATES.

    The Company is owned and operated in the United States and is designed to serve school districts located in the United States. We do not market the Services outside of the United States. If you are a non-US resident or if you visit the website from outside of the United States, you acknowledge that Personal Information we collect about you will be transferred to our servers in the United States and maintained there in accordance with our retention policy. This may require the transfer of your Personal Information out of your country of origin with laws governing data collection and use that may differ from or be more restrictive than U.S. law, or may result in governments, courts, law enforcement, or regulatory agencies having access to or obtaining disclosure of your Personal Information pursuant to the laws of the applicable foreign jurisdiction. By allowing us to collect Personal Information about you, you consent to this Privacy Notice and the transfer and processing of your Personal Information as described in this paragraph, and you waive any and all remedies that you may have based on the laws of your jurisdiction.

  9. HOW DO YOU CONTROL YOUR DATA?
    In Short:
    You can control your data through your account, by contacting your school district, or by adjusting your device settings.  

    Your Account. You may review, change, or terminate your account at any time. If you require assistance, please contact us at info@syseducation.org.

    Emails. We may send you informational or support emails related to your account. Depending on your communication preferences, we may also send you marketing emails. If you do not wish to receive emails from us, you can unsubscribe or change your preferences via the links provided in the emails or send a request to info@syseducation.org. Note that if you opt-out of marketing communications, we may still send you non-promotional communications, such as those about your account or our ongoing business relations.

    Device Settings. You can control the data we collect through cookies and related technologies by adjusting your device settings or your cookie preferences on the Site.

    Do Not Track. Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

    Privacy Requests. You can withdraw your consent, exercise your rights, express concerns, complain, or request information by contacting , please submit a request form by clicking here.

    We can only assist with or fulfill a privacy request when we have sufficient information to verify that the requester is the person or an authorized representative of the person about whom we have collected Personal Information, and to properly understand, evaluate, and respond to the request. We do not charge a fee to process or respond to a verifiable request unless we have legal grounds to do so. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We endeavor to respond to privacy requests in accordance with the requirements of the law applicable to your jurisdiction. If we do not fulfill your request within the legally required timeline, you can appeal our response by contacting info@syseducation.org.

  10. WHAT ARE YOUR PRIVACY RIGHTS?

    In Short:  Depending on where you live or are located, you may have certain rights over your Personal Information that we collect and retain.

    In the United States, consumer privacy is governed by federal privacy laws covering specific industries or data uses and state privacy laws providing with general consumer privacy rights. This section provides informational notices for state privacy laws like the California Consumer Privacy Act of 2018 (“CCPA”) and similar laws in Colorado, Connecticut, Nevada, Utah, Virginia, and other states require companies to inform consumers about their privacy rights and provide a method to exercise those rights. Residents of states offering privacy protections (each a “Consumer”) can exercise their privacy rights as applicable to our Services by submitting a Privacy Request. We these notices as a courtesy with respect to any privacy law not applicable to us.

    • Right to Correct. You have the right to request that we correct inaccurate Personal Information about you on our systems. If you become aware that the Personal Information that we hold about you is incorrect, or if your information changes, please inform us and we will update our records.

    • Right to Deletion. You have the right to request that we delete your Personal Information that we collected and retained, with certain exceptions. We may permanently delete, deidentify, or aggregate the Personal Information in response to a request for deletion. 

    • Right to Access. You have the right to request confirmation that we have collected Personal Information about you and that we provide you with access to that Personal Information. If you submit an access request, we will provide you with copies of the requested pieces of Personal Information in a portable and readily usable format. Please note that we may be prohibited by law from disclosing certain pieces of Personal Information, and we may be limited in the number or frequency of requests we must fulfill.  

    • Right to Disclosure. You may request that we disclose information to you about our collection and use of your Personal Information, such as: (i) the categories of Personal Information we have collected about you; (ii) the categories of sources for the Personal Information we have collected about you; (iii) our business purpose for collecting, using, processing, sharing or selling that Personal Information, as applicable; (iv) the categories of third parties with whom we share that Personal Information; and (v) if we sold or shared your Personal Information under the CCPA, two separate lists stating: (a) sales or sharing, identifying the Personal Information categories that each category of recipient purchased; and (b) disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained. Certain laws may limit the number or frequency of requests we must fulfill.   

    • Limited Use and Disclosure of Sensitive Personal Information. You have the right to opt-out or limit our use of your sensitive Personal Information. We do not seek to collect sensitive Personal Information about any individual, and in no case do we disclose any sensitive Personal Information for the purpose of inferring characteristics about you or otherwise use your sensitive Personal Information without your consent. If this ever changes in the future, we will update this Privacy Notice and provide you with methods to opt-out or limit our use and disclosure of sensitive Personal Information. 

    • No Selling or Sharing. Some states entitle consumers to opt-out of the sale or sharing of Personal Information or targeted advertising practices. We do not sell your Personal Information or share your Personal Information with third parties for cross-contextual behavioral advertising purposes. If this changes in the future, we will update this Privacy Notice and provide you with a method to opt-out. 

    • No Profiling. You have the right to opt-out of automated profiling. We do not process your Personal Information to evaluate, analyze, or predict your interests and preferences or otherwise use automated profiling to produce significant effects that concern you. If this changes in the future, we will update this Privacy Notice and provide you with a method to opt-out. 

    • Right to Nondiscrimination. We will not discriminate against you for exercising your privacy rights. For example, unless permitted by law we will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services; (iii) provide you a different level or quality of goods or services; (iv) retaliate against you as an employee, applicant for employment, or independent contractor for exercising your privacy rights; or (v) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services, because you exercised a right under applicable privacy laws.

    • Right to Disclosure of Marketing Information. California’s Shine the Light Act (Civil Code sections 1798.83-1798.84) entitles California residents to request certain disclosures regarding Personal Information sharing with affiliates and/or third parties for marketing purposes.

    If you are a Consumer, you may exercise these rights by submitting a Privacy Request. Only you or someone legally authorized to act on your behalf may make a verifiable Privacy Request related to your Personal Information. You may also make a verifiable privacy request on behalf of your minor child. You may designate a third party to exercise your rights – an authorized agent – however we will require written proof of the authorization and potentially proof of your identity.

  11. DO WE MAKE UPDATES TO THIS NOTICE?
    In Short:
    Yes, we will update this notice as necessary to stay compliant with relevant laws.
    We may update this privacy notice from time to time. The updated version will be indicated by an updated "Revised" date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.
